Intellectual Property Notice

Rights to artwork remain the sole property of Turtle That Paints including after purchase. This includes the purchase of originals, commissions, prints and current and/or future reproductions of any kind. The purchase of any item, original or otherwise, does not grant the customer permission to mint the piece into an NFT, print and distribute in any form or reproduce in any way by means of profit and/or otherwise.

Collectors may not reproduce artwork in any way without express written permission from the artist. Posting images of the items purchased on social media are always welcome and does not breach this clause.

Liability

We are not liable for goods once they are in the possession of the collector. It is not our duty to refund, exchange, replace or compensate by any means for the damage of products that have been mishandled by customers. For example: smudging fingerprints on the white border, tearing fine art prints, damaging works, etc.

As guaranteed under consumer protections, compensation for damage is due if/when damaged products are received when impacted by postal services and/or faulty merchandise has been dispatched. Every print is inspected several times before clearing quality control for shipment and only pristine purchased reproductions are packaged for you to enjoy.

Please read the product descriptions thoroughly and carefully. It is not our duty to compensate customers who do not read the information provided in the product description prior to purchase. All prints come with borders that are included in the final size of the listing.

Bidding Terms & Conditions

1. Eligibility:

   • All bidders must be at least 18 years of age.
   • By placing a bid, you confirm that you are legally eligible to participate.

2. Bidding Process:

   • Each auction will start at a predetermined base price.
   • Subsequent bids must meet or exceed the minimum bid increment specified for that auction.
   • Bidding is conducted in real time, and each bid constitutes a legally binding offer to purchase the artwork under the terms set forth herein.

3. Buyout Option:

   • A “Buyout Price” may be set for an auction.
   • If a bid meets or exceeds the buyout price, the auction will immediately conclude, and the artwork will be sold at the buyout price.

4. Finality of Bids:

   • Once placed, bids are final and cannot be retracted or cancelled.
   • At the close of the auction, the highest bid will be deemed the winning bid, which will result in a binding contract between the bidder and Turtle That Paints.

5. Payment & Collection:

   • Winning bidders must complete payment for their purchase within the timeframe specified in the auction details.
   • Failure to pay within the allotted time may result in cancellation of the winning bid and forfeiture of any rights to the artwork, and may also subject the bidder to legal action for breach of contract.

6. Authenticity & Fair Play:

   • Only genuine bids are permitted.
   • Any attempt to manipulate the bidding process through fake bids, shill bidding, or any form of fraudulent activity is strictly prohibited.
   • Turtle That Paints reserves the right to cancel any bids deemed fraudulent or in violation of these terms, and such actions may lead to legal consequences including civil or criminal proceedings.

7. Auction Modifications & Cancellation:

   • Turtle That Paints reserves the right to modify, postpone, or cancel any auction at its sole discretion without prior notice.
   • In the event of any changes, any accepted winning bids will remain binding unless otherwise specified.

8. Legal Implications & Dispute Resolution:

   • By placing a bid, you acknowledge and agree that your bid is a legally enforceable offer to purchase the artwork under these Terms & Conditions.
   • Any breach of these terms by a bidder may result in legal action for damages or specific performance, as determined by applicable law.
   • All disputes arising from or related to the auction process shall be governed by the laws of the jurisdiction in which Turtle That Paints operates, and you consent to the exclusive jurisdiction of its courts for any legal proceedings.
   • Turtle That Paints shall not be liable for any indirect, incidental, or consequential damages resulting from the auction process.

9. Acceptance of Terms:

   • By placing a bid, you agree to be bound by these Terms & Conditions, including all legal implications contained herein.
   • Turtle That Paints reserves the right to amend these terms at any time without prior notice, and continued participation in the bidding process constitutes your acceptance of any such changes.
